What is the E-2 Visa?​​​​​​​​​​​​​​​​​​​​​

The E-2 visa is a nonimmigrant visa for citizens of treaty countries, allowing them to invest in and run a U.S. business.

 

It enables entrepreneurs to live and work in the U.S. while managing their investments.

 

The visa is initially granted for up to five years and can be extended if the business continues to meet requirements.

​Who Qualifies for an E-2 Visa?

To qualify for an E-2 visa, you must meet several essential criteria:

Treaty Country Citizenship:

You must be a citizen of an E2 treaty country. View the list of treaty countries.

Substantial Investment:

You must make a substantial investment in a U.S. business, enough to ensure its successful operation. There is no set minimum, but it should be significant relative to the business's total cost.

Active Investment:

Your investment must be an active, operational enterprise. Passive investments, such as stocks or real estate, generally do not qualify.

Ownership and Control:

You must own at least 50% of the U.S. business or have operational control through a managerial position.

Intent to Depart:

​​ You must intend to leave the U.S. when your E-2 status expires.
